Welcome to ProofCode. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By creating an account or using ProofCode's services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Description of Service
ProofCode is a technical interview generation platform that analyzes candidate codebases to create highly specific, evidence-based interview questions. Our service helps recruiters and hiring managers conduct more effective technical sessions.
3. User Accounts
3.1 Account Creation
To use ProofCode, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are using the service on behalf of a company, you represent that you have the authority to bind that company to these Terms.
3.3 Account Security
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.
4. Payment Terms
4.1 Pricing
Our services are provided on a subscription basis. Current pricing is available on our website.
4.2 Payment Processing
Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the fees due.
4.3 Refunds
Refund requests are evaluated on a case-by-case basis. Contact us at contact@proofcode.dev for refund inquiries.
4.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled. You will be charged the then-current subscription fee upon each renewal.
4.5 Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access until the end of your current billing period. No refunds are provided for partial billing periods.
5. User Conduct
You agree not to:
- Use the service for any illegal purpose
- Upload malicious code or attempt to compromise our systems
- Share your account credentials with third parties
- Use the service to discriminate against candidates based on protected characteristics
- Misrepresent your identity or affiliation
- Violate any applicable laws or regulations
6. Intellectual Property
6.1 Our Property
ProofCode, its logo, features, and functionality are owned by us and are protected by intellectual property laws.
6.2 Your Content
You retain ownership of any code or content you submit. By using our service, you grant us a limited license to process your content solely for the purpose of providing the service.
6.3 Generated Questions
Interview questions generated by ProofCode are provided for your use in conducting technical interviews. You retain the right to use any questions generated during your active subscription, even after your subscription ends or is cancelled.
7. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. Termination
8.1 By You
You may terminate your account at any time by contacting us or using the account settings.
8.2 By Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide reasonable notice before termination when possible, except in cases of serious violations or legal requirements.
8.3 Effect of Termination
Upon termination, your right to use the service ceases immediately. Your personal data will be deleted immediately, except where retention is required by law (e.g., billing records for tax purposes). See our Privacy Policy for details on data retention.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
ProofCode is a tool to assist in technical interviews. The final hiring decision remains your responsibility. We do not guarantee any specific outcomes from using our service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless ProofCode, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these Terms.
12. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent French courts.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ProofCode regarding the use of our services. These Terms supersede any prior agreements or communications between you and us.
16. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the service. Your continued use after changes take effect constitutes acceptance of the modified Terms.
